Industry Alert: Lawsuit by Major Auto Payers Against a "Soft-Tissue" Provider Alleging Fraud ... Are PI Provider Networks Next???
In July 2016, two major auto insurance payers filed suit in Federal Court against a chiropractor alleging fraud. The case should serve as a significant “heads-up” to any chiropractic office that treats a blend of cash and personal injury patients and raises the question: Are PI Provider Networks next? This is not a case where the payers are alleging that the practitioner was part of an accident ring, staging accidents, etc. Instead, the payers appear to be alleging that the doctor was:
• Using “Predetermined Treatment Plans” (e.g., Non-Varying, Non-Unique)
• Overutilizing X-rays Based on an ACA Policy
• Not Blending in Sufficient Levels of Active Care
• Charging Lower Fees for Cash-Paying Patients
• Advertising “Free Consultations”
• Advertising “Free Massages”
